The Minnesota RECALL Effort is Live!
The MNGOP and House Republicans are listening to frustrated Minnesotans from all over the state. The good people of MN are asking the ligament question of “Why won’t the house Democrat caucus go to work?” They continue to get paid but refuse to come to session, thus denying quorum and the house’s ability to organize. After being absent for 22 days and counting the Recall efforts are underway.
Background:
Initially after the general elections in Nov. the House was tied with 67 GOP and 67 DFL. It was later discovered that the newly elected Democrat from 40B did not reside in his district and was disqualified. This means there will be a special election. Until that time the numbers in the MN House are 67 – GOP, 66 – DFL, and 1- open seat.
The question then became what constitutes a quorum? The Republicans maintained it was the number of members available – 133; while the Democrats maintain it was the total number of House seats – 144. The MN Supreme court stepped in, sided with the Democrats and declared quorum to be 68. Many believe the decision by the all Democrat-appointed judges was either a misinterpretation of the constitution or an overstep of the Judicial branch’s separation of power. So now, the MN House finds itself in a stalemate. The Democrat caucus is holding up quorum until the republican caucus gives into their demands which include: a power sharing agreement and the seating of Brad Tabke (54A) in-spite of the multiple questions surrounding his race.
The MN House Republicans have been showing up to work every day, while the House Democrats continue to remain absent. According to State Law, a smaller group of MN state legislators can use the power of penalties to compel absent members to attend session. Secretary of State, Steve Simon, has taken it on himself to chair the House until a Speaker can be elected and continues to refuse to hear a motion to compel absent members to come to work. While the House Republican Caucus works to gather a quorum in order to conduct business; the MNGOP has initiated a statewide recall effort for all House Democrats who continue to be derelict in their duty by refusing to attend session.
